Factor in that getting a group of people (the "class action" group) to agree on anything is nearly a lost cause (the larger the group, the worse it gets) and you see why most class action suits go nowhere or only produce results for the law firm that brings them on. The actual people in the "class" usually get very little, if anything.
Is Mobil 1 0-40 the only oil they recommend under all conditions? If you live in a warmer climate do they recommend a higher initial viscosity oil? I don't think that your oil consumption is way out for a small performance engine, but if you're in a warm climate you may improve it some by using a different grade. Mobil 1 is real "slippery" like most synthetics, and can get past valve stem seals real easy.
If it runs at all then it's getting spark at least sometimes. Even though it has a new fuel pump I would check the fuel pressure and flow rate. It could be many problems, can't really say without more info.

If that turns out to be the case, I'd walk away from it. It's a buyers market on the used side and there's lots of other choices.
